1. Acceptance of Terms

By accessing and using Sytale's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services

Sytale provides website design, development, hosting, and maintenance services. We offer various subscription plans for ongoing website management and support.

Our services include but are not limited to:

  • Custom website design and development
  • Website hosting and maintenance
  • Content updates and modifications
  • Technical support
  • Security monitoring and updates
  • Performance optimization

3. User Accounts

To access certain features of our service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • Provide accurate and complete information
  • Update your information promptly
  • Notify us immediately of any unauthorized use
  • Accept responsibility for all activities under your account

4. Payment Terms

Payment for our services is due according to the billing cycle you select (monthly or annually). All fees are non-refundable except as expressly stated in our refund policy.

We reserve the right to change pricing at any time, with 30 days notice for existing subscribers. Price changes will not affect the current billing period.

5. Refund Policy

Subscription Refunds

Refunds are available for the first 30 days only for subscriptions. This excludes costs that we cannot refund ourselves, including:

  • Domain name registration (usually around $20 but can vary)
  • Booking system activation fees

After 30 Days

After the first 30 days, you can cancel your subscription at any time. Your website will remain active until the end of your current billing period (monthly or yearly term). At the end of the term, your website will be taken down unless you renew your subscription.

One-Time Services

Refunds for one-time services (such as initial website development) are available within 7 days of delivery, provided the work has not been customized according to your specifications.

6. Third-Party Services

Our services integrate with various third-party providers. By using our services, you also agree to comply with these third parties' terms:

Web3Forms

We use Web3Forms for handling contact forms and mailing functionality. Their terms of service can be found at https://web3forms.com/terms.

Setmore

We integrate with Setmore for booking and appointment management. Their terms of service are available at https://www.setmore.com/#terms-of-use.

Stripe

We use Stripe for payment processing. Their privacy policy and terms can be found at https://stripe.com/en-ca/privacy.

Other Third Parties

We also utilize:

  • Cloudflare for hosting and security
  • GitHub for version control and deployment
  • Various domain registrars for domain management

You acknowledge that your use of these services is subject to their respective terms and policies.

7. Intellectual Property

All content, features, and functionality of our services are owned by Sytale and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your content and data, but grant us a license to use it for providing our services. We retain ownership of any custom code, designs, or templates created for your website.

8. Limitation of Liability

Sytale shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount paid by you for our services in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to our services will cease
  • We will provide reasonable assistance in data migration
  • Outstanding payments remain due
  • Your website will be taken down at the end of your billing period

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
